About these terms

Jones Photo is operated by Owen Jones and is based in Massachusetts, United States. These terms cover using this website and buying digital photographs through it. They go with the Personal Use License, which says what you may do with photographs you buy, and the Privacy Policy, which says what information the website collects.

If you hire Owen Jones for a shoot or another service, any separate written agreement for that work applies to it. These terms do not replace such an agreement. Permission from the people, schools or other owners of what appears in a photograph is a separate matter, and these terms do not create it.

Using the website

Use the website lawfully, and respect the privacy of the people in the photographs. Do not try to get around a password, a private or restricted gallery, or any other access control. Do not interfere with how the site works, and do not try to get files you have not been given access to.

Photographs on this site are protected by copyright. Seeing a photograph here does not give you a license to use it beyond viewing it on the site.

A password or a private link lets you view a gallery. By itself it is not a license to reuse the photographs in it. Galleries can be made private, changed or taken down.

Order and download links are private links: anyone who has one can use it, so keep yours to yourself.

Buying photographs

• What is sold. Photographs are sold as full-resolution digital files, either single photographs or a whole gallery. Your cart shows what you are buying and the total before you pay. A purchase covers the items on your order; it does not cover every photograph from an event unless you bought the whole gallery. If the photographs you pick from one gallery would cost as much as the whole gallery, the cart may switch you to the whole gallery for its price, and it tells you when it does.
• Prices and tax. Prices are in US dollars. Sales tax, where it applies, is worked out at checkout from your billing address and added to the total you confirm there.
• Paying. You pay on a page hosted by Stripe, our payment processor. Your card details go to Stripe, not to this website, so never send card numbers or security codes by email or through the contact form.
• After you pay. When Stripe confirms the payment you see your order page with your downloads, and a receipt with your download link is emailed to the address you gave at checkout.
• What a purchase does not include. It is a digital file only. It does not include prints, video or a shoot unless that is agreed separately in writing.

Your license and copyright

Photographs bought through this website are licensed to you under the Personal Use License, unless a different written license is expressly included with your purchase. It is a non-exclusive, perpetual license for personal, non-commercial use. It does not allow advertising, paid or commercial use, resale, relicensing or sublicensing. Please read it before you buy.

Buying a photograph does not transfer copyright. Copyright and ownership stay with Jones Photo; the license is permission to use the file in the ways it describes, and nothing more. It does not give you the permission of the people, or of the owners of the names, logos or property, that appear in a photograph.

Downloads and delivery

Your receipt and your order page are how you get your files. Order links can expire, and each photograph may have a limit on how many times it can be downloaded; your receipt and order page explain what applies to your order.

Some galleries also offer downloads without a purchase. For those you may be asked for an email address or a gallery password first, and the conditions can differ from those of a purchase.

Your license can last indefinitely, but the website, an order link and a download allowance do not. Download your files while the link works and keep your own backup.

If a file is missing, wrong, incomplete or damaged, won’t download, or your receipt never arrived, write to owen@jonesphoto.me with your order number, the email address you used and a description of the problem. Please don’t buy the same photograph again to fix a delivery problem.

Refunds and corrections

Jones Photo reviews delivery problems, duplicate purchases and incorrect files case by case. Email owen@jonesphoto.me with your order number, the email address used for the purchase and what went wrong. Depending on the situation, the answer may be corrected files, help getting access back, or a refund.

Each request is looked at on its own facts, so asking is not a promise of a particular result. If an order is fully refunded, its download links are switched off.

Nothing on this page limits any right or remedy the law gives you. Please do not send card numbers or security codes.

Photographs of people

If you are concerned about a photograph, its caption or who can see it, email owen@jonesphoto.me. The Privacy Policy says how to ask and what to include. A parent or guardian can ask about a photograph of their child. Each request is looked at in context, and the answer can depend on who owns the photograph and on any requirements that apply. Taking a photograph off this site cannot take back copies that other people already have.

Photo alerts and messages

Photo alerts are separate from buying. Buying a photograph does not sign you up for them. Alerts start only after you confirm by email, and every alert has an unsubscribe link. Messages you need for an order, a download you asked for or support, such as a receipt, a download link or a reply, are sent whether or not you have signed up for alerts.

Other services and interruptions

Payments go through Stripe, and some links lead to other websites. They have their own terms and privacy practices, and Jones Photo does not control them. The website and its downloads can be unavailable or change from time to time. That does not affect the delivery help and refund review above.

Promises and liability

The Personal Use License says what is and is not promised about the photographs themselves. Nothing in these terms or in that license removes or limits a warranty, right or remedy that the law does not allow to be removed or limited.

Changes to these terms

Jones Photo may update these terms for future use of the website and future purchases. The date at the top of this page shows when the current version took effect. An update does not automatically replace the license you were given with an earlier purchase.
